00:00The unanimous decision of this court is that the terms woman and sex in the Equality Act 2010 refer to a biological woman.
00:10The absence of coherence within the statute and the practical problems which arise demonstrate that that interpretation is not correct.
00:36It follows that the interpretation of woman in the Scottish Government guidance on the 2018 Act is incorrect and the challenge to that guidance succeeds.
00:47Further, the principle of discrimination by association remains part of our law, C-section 19A of the EA,
00:56and protects transgender people against indirect discrimination regardless of whether they possess gender recognition certificates.
01:06A certified sex reading is not required to achieve any relevant purpose in relation to indirect discrimination.
