00:00The High Court has granted leave to Naima Khalid, the widow of former Finance Minister
00:06Daim Zainuddin, to commence judicial review proceedings to challenge the Inland Revenue
00:10Board's tax claim of RM313.8 million.
00:16Her counsel, S. Saravana Kumar, said the court was satisfied that his client's application
00:21for leave had merit, Burnama reported.
00:24Speaking outside the courtroom, S. Saravana Kumar said Justice Shana Sulaiman held that
00:30Naima's application was neither frivolous nor vexatious and that it raised legal questions
00:35warranting a substantive hearing.
00:38On October 18, 2024, the same court dismissed Naima's application for a temporary stay of
00:44the order, requiring her to settle RM313.82 million in income tax arrears to the LHDN.
00:51The court had ruled that there were no exceptional circumstances to justify the stay and affirmed
00:57that LHDN was empowered under the Income Tax Act 1967 to enforce collection.
01:04However, on October 28, 2024, the Court of Appeal unanimously allowed Naima's application
01:09for a temporary stay of the payment order.
