An ex-federal prosecutor is weighing in on Diddy's assault video -- and she says while this isn't necessarily a smoking gun in the investigation he's facing, it certainly doesn't help him.

We talked to Katie Cherkasky -- who's had years of experience with these sorts of legal matters -- on "TMZ Live" Friday ... where she declared that the now-viral video, in which Diddy can be seen beating Cassie -- should make him and his camp worried.

00:02 - Your reaction when you saw this video,
00:05 just as a human being watching this,
00:09 and that it is a different side of Diddy
00:13 than the public has ever seen.
00:15 - Well, as a human being,
00:16 obviously it's very tough to watch.
00:18 As a criminal defense attorney,
00:19 I wanna say, when will people learn
00:21 that there are cameras everywhere?
00:23 And obviously this does completely contradict
00:26 Diddy's claims that he had nothing to do
00:28 with these allegations.
00:29 The statute of limitations on domestic violence charge
00:33 has passed for charging that specific crime.
00:35 But the bigger issue for him
00:36 is that there's a huge federal probe
00:38 that gets into all of these allegations,
00:41 some of which Cassie has made against him,
00:43 that are not barred by the statute of limitations.
00:45 And certainly that corroborates her claims,
00:48 at least to a large degree here,
00:50 on those remaining charges.
00:52 - Diddy, as far as we know,
00:53 this is an investigation for alleged sex trafficking,
00:56 not necessarily domestic violence
00:59 in the state of California.
01:00 So how does it affect the federal investigation?
01:04 - Well, it puts him in a very difficult position
01:07 because if he is ever charged,
01:08 whether on the state side or federally,
01:11 if he ever testifies,
01:13 there's going to be limitations
01:14 on whether he can actually do so
01:16 without being confronted with things like this.
01:18 So there's a lot of collateral impacts of this video,
01:21 even if those particular acts
01:23 are not being charged in the federal case.
01:25 Cassie's also made claims of sexual violence against him,
01:28 which are not barred by the statute of limitations,
01:30 as have other individuals.
01:32 So it puts him in a very difficult position
01:35 as he's already on record as essentially lying
01:38 about his conduct, which we now see.
01:41 - If you're Diddy and you see that this video is now out,
01:44 you would be worried, right,
01:46 about what, if any, conversations Cassie is having
01:50 with federal prosecutors?
01:52 - Oh, I think he's probably pretty worried.
01:54 And yeah, absolutely,
01:55 the videos definitely bolster Cassie's credibility
01:58 with regard to not only these offenses,
02:00 but anything else that she has relayed to them.
02:03 It doesn't mean that they don't have
02:04 to get independent evidence
02:05 to support those other allegations,
02:07 but certainly she's proven herself to be credible
02:10 through the release of this video.
02:12 - His credibility, you say that bolsters hers,
02:15 but his credibility is really kind of shot
02:16 with the public at this point, right?
02:18 - I would imagine so,
02:19 at least to the extent that they now see
02:21 that this directly contradicts his denials.
02:24 But like you said, this was a state case.
02:26 It's past the statute of limitations.
02:28 He was intoxicated.
02:29 He's sorry.
02:30 It was an unfortunate moment.
02:32 It was caught on camera.
02:33 You can't really deny that at this point.
02:35 But whether that proves up other charges,
02:38 it does not directly prove up any other charges,
02:40 but it certainly leads to the idea
02:42 that there might be some credibility
02:44 to other things that Cassie has relayed,
02:46 and others for that matter, based upon this video alone.
