BIR sa tax woes: ‘Ipinapatupad lang namin ang batas’

Mariing pinabulaanan ngayon ng Bureau of Internal Revenue (BIR) na may bagong buwis itong ipinapataw sa mga government employees, lalo na sa mga natatanggap na benipisyo ng mga ito.
Ayon kay BIR Commissioner Kim Henares, ang kanilang inilabas umano ay ang Revenue Memorandum Order (RMO) para bigyang linaw ang itinatakda ng Section 32 ng National Internal Revenue Code of the Philippines, partikular ang tungkol sa kinukuhang income tax.
Giit ni Henares, malinaw umano ang batas na ang lahat ng kompensasyon, maging ito ay cash o in kind, ay may kaukulang buwis.
“We would like to clarify that we did not impose any new tax. We issued an RMO (Revenue Memorandum Order) to clarify that under Section 32 of the Tax Code, all compensation, whether in cash or in kind whatever they may be called, are subject to income tax and therefore, proper withholding tax should have been deducted and remitted. Only exemption is up to P30,000 of the 13th month pay and bonuses,” giit ni Henares.
Una rito, umalma ang grupo ng mga government workers sa sinasabing bagong pasanin nila sa buwis.
Dumulog pa ang mga ito sa Supreme Court para ibasura ang anila’y “oppressive taxation” ng BIR.
“This has been the law since 1997.. The obligation to withhold of government is further emphasized by Section 272 (of the Tax Code) because it provides a penalty for violation committed by government,” giit ni Henares.
